LAW 7302 - Community Property


The organizing idea for the text and the course is that California community property is a “classification” system; property is either community or separate property based upon the date and source of acquisition of the property.  Problems arise when spouses claim separate property interests in community property, community property interests in separate property, devote community effort to separate property, or make agreements, before or during marriage, or after date of separation or dissolution of the marriage, but before judgment is entered, on their property issues.  All these issues, and more, from acquisition of community property to its division upon dissolution of marriage, will be explored.  Note: Professor Terrazas requires students to have completed a Community Property course prior to taking the Family Law course (Spring 2025), with no exceptions. Letter grade. 2 credits
